Taiwan Work Visa Application Procedures and Fees(Foreigners other than Residents of Hong Kong, Macau and Mainland China)

 

 

In order to work in Taiwan, a foreign worker must first sign an employment contract with the Taiwan employing company, where the company must then apply for a work permit from the Ministry of Labor before the worker may work in Taiwan. The applicant then applies for a Taiwan Visa to enable him to enter into Taiwan. Upon arrival, he will need to apply for a Alien Resident Certificate which allow him to live in Taiwan.

Note:

(1)    Fees do not include charges to be paid to the Taiwan Government;

(2)    Fees do not include delivery charges, if any;

(3)    The quotation does not apply to residents of Hong Kong, Macau and Mainland China.

(4)     Having an ARC means you are a permanent resident and you are entitled to National Health Insurance.

 

2.       Conditions for Application for Work Permit

 

(1)     New Company (company registered within one year)   

For limited company and company limited by shares, the amount of registered capital is NTD5,000,000 or more. For branch office, the amount of working capital is NTD5,000,000 or more.

 

(2)     Existing Company (company registered more than one year)

The amount of revenue for the last financial year is NTD10,000,000 or more or the average amount of revenue for the last three financial years is NTD10,000,000; or if the company in trading business, the total amount of import and export is USD1,000,000 or more, if the total commission derived from the trading activities is USD400,000 or more.

 

(3)     Other Circumstances

Representative offices established by foreign companies with actual operation; Research and development centres or operation headquartered established by foreign companies and approved by the competent authority.

 

(4)     Company established by Foreigners within one year

The foreigner to be acting as manager of a limited company or company limited by shares where the foreign investor holds 30% of the equity or shares of the limited company or company limited by shares respectively. The person to be acting as representative of a representative office established by a foreign company.

 

(5)     Company established by Foreigners more than one year

The amount of revenue for the last financial year or the average amount of revenue for the last three financial years is NTD5,000,000 or 5 times of the amount of registered capital; or if the company in trading business, the total amount of import and export for the last financial year or the average amount of import and export for the last three financial years is USD500,000 or more, if the total commission derived from the trading activities is USD200,000 or more.

 

3.       Application Procedures

 

(1)     Firstly, an application for work permit is filed with the Taiwan Council of Labour Affairs;

(2)     Once granted a work permit, the applicant then applies for a resident visa;

(3)     After the applicant enters Taiwan with a Resident Visa, he then applies for an Alien Resident Card (ARC) within 15 days of arrival.

 

4.       Documents and Materials Required

 

(1)     The signed employment contract which they have given you

(2)     A health check (easily acquired from Taiwanese hospitals)

(3)     A copy of passport of the applicant;

(4)     A copy of the academic qualification certificates and resume

(5)     The registration documents of the employers;

(6)     A copy of the financial statements of the employer.

 

5.       Processing Time

           

In general, it takes 4-6 weeks to process a work permit application.

 

6.       Alien Resident Certificate in Taiwan

 

Once granted a work permit, the process for obtaining a residence visa and an Alien Resident Certificate (ARC) can begin. Having an ARC means that an expat is a permanent resident and therefore entitled to National Health Insurance.

 

However, in order to become a legal permanent resident and receive an ARC, expats must fulfil the following criteria at a minimum:

  • Be able to pass a health check that tests for HIV
  • Have a work permit (which will be arranged by their employer)
  • Have a residence visa (which can be applied for from within Taiwan if one has entered the country on a visitor’s visa)

 

An ARC is issued for the same length of time as a work permit. As soon as an expat's work permit expires or if they leave their place of employment, an ARC will become invalid.

 

7.      Notes

 

(1)     If you are already in Taiwan on a Visitor Visa, the application for resident visa can be filed in Taiwan upon after receipt of work permit. If you entered Taiwan without a visa or with a Landing Visa, you will need to leave Taiwan to apply for a Resident Visa.

(2)     If you are currently outside Taiwan, you should apply for a Resident Visa before entering Taiwan.
